CA's New Salary Privacy Law

Thoughts / Discussion on the new Salary Privacy Bill (https://goo.gl/AbvNAX).

Is asking an applicant to email resume, references, and rate the same as asking for your salary history? My "going rate" may not always be what I got paid last. Is asking for a "going rate" or "asking rate" a loophole?

Does this affect Independent Contractor positions? Regardless, is it a good best practice is to list in the job description: Employee or Contractor.

With the law also, "requiring employers to provide applicants, upon request, with a salary range for the jobs they seek," is it also a good best practice to preemptively post the rate range with the job posting.
